Supreme Court granted leave to proceed
Supreme Court granted leave to proceed for the fundamental rights petition filed against Officer in Charge and four other policemen attached to police post, Morantuduwa, Wadduwa.Wasantha Niroshan states in his petition to Supreme Court claiming that his fundamental rights were breached by Officer In Charge, Inspector Liyanarachi and other police constables by depriving his liberty illegally and fabricated charges against him.
On January 1st, 2011, he was arrested by policemen attached to Morantuduwa Police Post in his work place. Then he was brought to the police post and illegally detained for four days. Later, OIC Inspector Liyanarachi introduced 500gms of cannabis and produced him in Panaduara Magistrate Court with a brand-new motor bicycle alleging that he was arrested on January 3rd, 2011 when he was transporting cannabis.
Panadura Magistrate remanded him for 14 days. Subsequently, he was discharged by the same Magistrate rejecting the police claim that he was arrested when transporting cannabis.
He filed a petition in Supreme Court claiming that his fundamental rights guaranteed in the Constitution were violated by OIC, Inspector Liyanarachi of Morantuduwa police post.
Supreme Court granted leave to proceed and fixed date for argument on June 16th, 2012.
Up to now, Inspector liyanarachi and other policemen enjoy all the benefits of police officers, according to the prevailing situation in this country which guarantees to all uniformed criminals established by the present government.
